1. Introduction

These Terms of Service ("Terms") govern your access to and use of Supascale ("Service"), a division of Frog Byte, LLC ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

  • "Service" refers to the Supascale platform and all associated features, tools, and services.
  • "User", "you", or "your" refers to any individual or entity that accesses or uses the Service.
  • "Content" refers to any data, information, or materials uploaded, stored, or processed through the Service.
  • "Subscription" refers to the paid access to premium features of the Service.

3. Account Registration and Security

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

4. Service Usage and Restrictions

The Service and its original content, features, and functionality are owned by Frog Byte, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. User Content and Data

You retain ownership of your Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your Content solely for the purpose of providing the Service.

7. Payment and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • You are responsible for all applicable taxes

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FROG BYTE, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL FROG BYTE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Frog Byte, LLC and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions.
